Scope of this Policy

The Callsign Privacy Policy applies to Callsign Inc., of 2225 East Bayshore Road Palo Alto, California 94303, USA (“Callsign” or “we”). This Privacy Policy Statement explains how Callsign uses personal information collected or processed in connection with the provision of the Callsign mobile application provided through Apple’s App Store (the “Service”). This policy is effective 10 February 2014.

The Service is designed as an online application providing a facility for inputting, retaining and sharing personal details including names, addresses, telephone numbers, email addresses and other types of contact information with others and for identity authentication. The individual or organisation that subscribes to the Service will be referred to as the “Subscriber” or “you”.

“Personal Information”

The Callsign Privacy Policy concerns the use by Callsign of personal Information. Personal Information, or “personally identifiable information”, as it is sometimes known, is generally a reference to data that can be linked to or identified with a specific individual or a specific device.

This Privacy Policy does not apply to any data insofar as it is held, processed, disclosed or published in a form which cannot be linked to a living individual (such as anonymised data, aggregated data, or coded data which, in a given form, cannot effectively be used to extract Personal Information) (“Generic Data”). Callsign reserves the right to generate Generic Data out of any databases containing Personal Information and to make such use as it sees fit of any such Generic Data.

Personal Information collected in connection with the Service

In order to provide the Service, Callsign requires Subscribers to provide minimal details namely a name, email address and telephone number. The Service allows Subscribers to submit additional Personal Information to the Service for the purpose of sharing it with other Subscribers.

We automatically collect other information about you, including:

  • Your geographic location; and
  • Aggregated information that cannot be used to specifically identify you when you use the Service.

Personal information shared by you with third parties

When you share Personal Information through the Service with third parties (including other Subscribers), that information will remain under the control of the third party in question. Callsign has no control over the use of Personal Information which has been shared with third parties and this Privacy Policy Statement does not relate to the use of the Subscriber’s Personal Information. Where you share your Personal Information through the Service with another Subscriber, updates you make to that Personal Information through the Service will be automatically provided to other Subscribers with whom you shared that Personal Information and the data will be automatically updated on their devices, provided they remain subscribed to the Service.

More specifically, when you choose to share Personal Information with another Subscriber through our app, a number of items of your Personal Information (your name, telephone numbers and email address) will be copied and stored on the other Subscriber’s device (their smartphone or similar digital device) in their address book or directory folder. This Personal Information will then be available for use by the other Subscriber for general purposes such as Caller ID, recognition of messages and for email, telephone and SMS communications. Additional Personal Information items that you may include in your Callsign profile (such as your physical address, Skype handle, Facebook or LinkedIn user name and other data fields that may be available) and that you choose to share with other Subscribers, will be available to the other Subscribers through the app, for as long as you and the other Subscribers are connected through the app. Personal Information that you keep on your Callsign profile which is copied onto other Subscribers’ devices will be updated on these devices each time you update your Personal Information through the app, provided that you and the other Subscriber are still connected to each other through the Callsign service. The Personal Information stored on other Subscribers’ devices will no longer be updated if you or the other Subscriber stop using the Callsign service, or if you are no longer connected to each other through the service. Those items of Personal Information copied onto other Subscribers’ devices will remain stored on those devices (as last updated when you and the Subscribers were still connected) and will remain available for use by them for as long as they choose to keep it. Personal Information items shared through the app which are not copied onto other Subscribers’ devices will only be available to others through the app. Such Personal Information will no longer be available to other Subscribers if you discontinue the use of the app, or if the other Subscriber stops using the app, or if you and the Subscriber are no longer connected through the app.

Where the Service is used to authenticate or confirm your identity, you may use it to provide your Personal Information to a third party (in which case the above paragraph applies) and to confirm your identity (through the use of passwords and communications with your mobile device, location services and device information). The identity authentication process does not involve making any further Personal Information available to the third party on whose request the authentication service is provided.

How we use your information

Callsign uses Personal Information provided by Subscribers for the purpose of communicating with the Subscriber and administering, delivering, improving and personalising the Service.

Callsign may also use such data (insofar as permitted under applicable law) to communicate with you in relation to other products or services offered by Callsign or its partners. In accordance with the requirements of applicable law, Callsign may request you to confirm your consent for such communications (‘opt-in’) or to indicate that you would not like to receive such communications, or that such communication should be discontinued (‘opt-out’).

Where you give an opt-out notice, Callsign will not use your Personal Information for direct marketing purposes (but this shall not prevent use of the Personal Information in relation to the administration of the Service, or to provide technical and other support to you in relation to the Service).

Where an opt-in is required by applicable law as a pre-requisite for sending direct marketing communications, Callsign will not use your Personal Information for direct marketing purposes unless you provide the requisite opt-in.

How your information is disclosed

Information may be disclosed to third parties in accordance with our Privacy Policy.

Third Parties. We may use third parties to perform functions in connection with the Service such as administration services, technical services relating to the maintenance, servicing and upgrading of the products, software or services provided by Callsign, hosting services, data migration services, and analytical services. We may share information about you that these third parties need to perform their functions and in accordance with our agreements with them.

If you request a specific service or product, and if that product or service is administered by a third party who is working for or in partnership with Callsign, your Personal Information may be shared with the third party in order to respond to the request. The third party in question may also transmit back to Callsign any new information obtained from you or about you in connection with providing the service or product.

Business Changes. If we become involved in a merger, acquisition, sale of assets, joint venture, securities offering, bankruptcy, reorganization, liquidation, dissolution, or other transaction or if the ownership of all or substantially all of our business otherwise changes, we may share or transfer your information to a third party or parties in connection therewith.

Subsidiaries and Affiliates. We may also share your information with our subsidiaries and affiliates for purposes consistent with this Privacy Policy. Our subsidiaries and affiliates will be required to maintain that information in accordance with this Privacy Policy.

Investigations and Law. Regardless of the choices you make regarding your information (as described below), we may disclose information about you to third parties to:

  • Enforce or apply the Terms of Use;
  • Comply with law, in response to subpoenas, warrants, or court orders, or in connection with any legal process or cooperate with government or law enforcement officials or private parties;
  • Protect our rights, reputation, integrity, safety and property, or that of our users or others;
  • Protect against legal liability of Callsign, its partners or other users; or

Investigate, prevent or take action regarding suspected illegal activities, suspected fraud, the rights, reputation, safety or property of us, users or others, violation of the Terms of Use, our policies or agreements or as otherwise required by law.

Callsign will fully co-operate with law enforcement, investigation and security agencies and regulators to identify anyone who uses its service or software for illegal activities. Callsign reserves the right to report to law enforcement, investigation and security agencies and to regulators any activities that are believed to be unlawful.

Aggregated Information. We may share aggregated information relating to users of the Service with affiliated or unaffiliated third parties.

Storage, security and retention of Personal Information

Personal Information that Callsign collects is stored on its servers (which may be located outside the EEA). We implement and maintain security measures to protect such information stored on our servers and seek to comply with all local rules in respect of storage of data.

Notification in the event of breach

In the unlikely event of a breach in the security of Personal Information, Callsign may decide to notify any Subscriber who are actually or potentially affected. Callsign may elect to give notice via in-product messaging systems or via email (if such data is available to Callsign). Notice of data breach may also be given via publication on company website or on the product portals. Subject to applicable legal and regulatory requirements, Callsign reserves the right to decide whether or not to give notice of a data breach to Subscribers, and which Subscribers should be notified, and reserves the right to delay notification if it is asked to do so by law enforcement or other authorities, or if Callsign believes that giving notice will increase the risk of harm to its Subscribers.

“Sensitive” information

Callsign does not seek to collect “sensitive” Personal Information such as sexual preference, religion, political views, or health. Callsign does not wish to receive any such data and will not request it. If Subscribers voluntarily post such information on the Service or share it with other Subscribers, the Subscriber assumes the risk of such information being accessed, used or distributed by others with whom the information was shared.

Data on children

Persons under the age of 16 should not transfer personal information to us unless they have the consent of their parent(s) or guardian(s). We do not knowingly collect, nor do we want to receive, personal information about individuals who are under 13 years of age.

Contacting Callsign about privacy questions or concerns

If you contact Callsign by e-mail or letter, we may keep a record of your correspondence or comments. We may ask for your name, e-mail address and contact information in order to send you a reply.

Changes to your Personal Information and unsubscribing from the Service

You may change the Personal Information that Callsign retains about you by accessing the Service and following the instructions. Whenever you update, amend or change your Personal Information, Callsign will automatically update your details on other Subscribers’ directories if you have previously used the Service to share such details with that Subscriber.

You may unsubscribe from the Service at any time. When you unsubscribe from the Service (or when it is otherwise terminated) we will permanently and irretrievably delete all Personal Information we hold on your behalf, save that:

  1. copies of your Personal Information may remain stored for limited periods of time on back-up media which shall be cleansed from time to time;
  2. if you have elected to share your details with other Subscribers, some of your details (your name, telephone numbers and email address), as current immediately before you left the Service, will continue to remain available to such Subscribers on their devices and under their sole control;
  3. Callsign reserves the right to retain records of your Personal Information if we reasonably require to maintain such records for legal purposes including to comply with our legal or regulatory duties, to investigate and respond to complaints (including from other Subscribers), to enforce our Terms of Use or to defend ourselves against any claim or legal threat or allegations, or if we require to retain such data for other legitimate reasons; and
  4. Callsign shall be entitled to retain any data in non-Personal Information form which may have been extracted or obtained from your Personal Information including any aggregated, anonymised or otherwise de-personalised data.

Privacy Policy changes

This Privacy Policy was last changed on 10 February 2014. If Callsign makes changes to the Privacy Policy, the new version will be posted on the Service. Callsign may change, modify, add or remove portions of this Privacy Policy at any time, and any changes will become effective immediately upon being posted unless stated otherwise. If Callsign makes material changes to the Privacy Policy, we will notify you by email to the email address you have provided.

Your California privacy rights

Section 1798.83 of the California Civil Code permits California residents to request from a business, with whom the California resident has an established business relationship, certain information about the types of personal information the business has shared with third parties for those third parties’ direct marketing purposes and the names and addresses of the third parties with whom the business has shared such information during the immediately preceding calendar year. We neither can control nor are responsible for the privacy practices of Google.

  • Business Changes.
